Small Business License Rules & Regulations

Small businesses are subject to similar licensing rules and regulations as large businesses are, but the licensing rules may differ depending on the type of small business you are considering. The specific licensing requirements, rules and regulations for any small business depends on where the business is located. Some cities have local ordinance rules while counties and states may have additional license requirements that depend upon the type of business being operated.

General License - Most areas of the country require small businesses to obtain a general business license. General business licenses are normally issued by the county or state the business is operating in, but specific laws may require a small business to obtain their operating license from a specific entity such as the board of health.

Occupational Permit - Occupational permits are required to meet specific zoning ordinances or as permits for specific types of business occupations. Some cities require a home occupation permit for example, for small businesses to operate out of a home office. Other cities or states may require special permits for massage therapists or home health care nurses as well.

Fictitious Name - A fictitious name statement or DBA (Doing Business As) filing is not technically a license or permit, but a common formal filing needed for small businesses. When a small business is operated under an assumed name that doesn't match the owner's legal name, the fictitious name statement or DBA is an official declaration of the businesses name. According to the U.S. Small Business Association, some states make this filing optional while other states require it.

Sales Tax ID - Small businesses are required to have a sales tax ID or sales and use permit if they are selling taxable goods as part of their business. Depending upon the state the business operates in, the sales tax permit may be required regardless of the type of business or whether it's selling tangible goods.
